This Privacy Policy ("Policy") explains how That's No Moon LLC, doing business as Focus Sherpa ("Focus Sherpa," "we," "our," or "us"), collects, uses, and shares your information when you use our services. Our address is 8735 Dunwoody Place #5707, Atlanta, GA 30350.

Focus Sherpa is a productivity accountability service. We deliver our service through a combination of our website (focussherpa.com), a web application, WhatsApp messaging, Zoom video sessions, Google Sheets, and email. Together, these are referred to as the "Services" throughout this Policy.

By using our Services, you agree to the collection and use of your information as described here. If you do not agree, please do not use our Services.

1. Information we collect

Information You Provide

Account information: When you sign up, we collect your name, email address, WhatsApp phone number, and a password.

Payment information: When you purchase a plan, Stripe (our payment processor) collects your payment card details, billing address, and transaction information. We do not store your full card number on our servers.

Task and goal information: You share your tasks, goals, and progress updates through our shared Google Sheet and WhatsApp check-ins. This is core to delivering the service.

WhatsApp messages: Your daily check-in conversations with your Accountability Sherpa are part of the service. These messages include task lists, progress updates, and general communication about your goals.

Call information: If you are on a plan that includes Follow Through calls, we may take notes during your call to track your goals and progress. Calls are conducted via Zoom or phone.

Communications: If you email us, submit a support request, or provide a testimonial, we collect the content of those communications.

Information Collected Automatically

Website analytics: We use Google Analytics (via Google Tag Manager) and the Meta Pixel to understand how visitors interact with our website. This includes information like pages visited, time on site, referring source, browser type, and device information.

Cookies: We use cookies for analytics and advertising purposes. See the Cookies section below for details.

IP address and device information: Collected automatically when you visit our website.

Information We Do Not Collect

We do not collect GPS or precise geolocation data. We do not collect information from children. Our Services are not directed at anyone under 13. We do not ask you to store sensitive personal information (financial account numbers, government IDs, medical records) in your task lists, and you should not do so.

2. How we use your information

To deliver the service: Your Accountability Sherpa uses your task data and WhatsApp messages to provide daily check-ins, track your progress, and produce your monthly reports. Your Strategy Sherpa uses call notes and task history to conduct Follow Through calls.

To process payments: We use Stripe to charge for plans and manage subscriptions.

To send you service-related emails: We use Kit.com to send transactional emails such as welcome messages, session schedules, and progress reports. These are not marketing emails; they are part of the service.

To improve our website and marketing: We use Google Analytics and the Meta Pixel to understand what brings people to our site and how they interact with it.

To communicate with you: We may email you about changes to the service, new features, or to request a testimonial.

To protect our business: We may use your information to detect fraud, enforce our Terms & Conditions, and comply with legal obligations.

3. Who we share your information with

We do not sell your personal information. We share it only with the following parties, and only to the extent necessary to operate the service:

Your Sherpas: Your Accountability Sherpa and Focus Sherpa see your task data, WhatsApp messages, progress reports, and call notes. This is how the service works.

Stripe: Our payment processor. Handles all payment card data. See Stripe's privacy policy at stripe.com/privacy.

Kit.com: Our email provider. Receives your name and email address to send service-related emails.

Google (Analytics and Workspace): Google Analytics receives anonymized website usage data. Google Workspace (Gmail, Sheets) is used for internal operations and your shared task tracker.

Meta: The Meta Pixel on our website sends anonymized browsing data to Meta for ad targeting and measurement. No task data or personal messages are shared with Meta.

Zoom: Used for moderated coworking sessions and Follow Through calls. Zoom's own privacy policy applies to data processed during sessions.

Law enforcement: We will disclose information if legally required to do so, or if we believe in good faith that disclosure is necessary to protect our rights, your safety, or the safety of others.

Business transfers: If Focus Sherpa is acquired, merged, or sells assets, your information may be transferred as part of that transaction. We will notify you before your information becomes subject to a different privacy policy.

4. WhatsApp and SMS communications

WhatsApp is the primary channel through which your Accountability Sherpa communicates with you. By signing up, you consent to receiving daily WhatsApp messages as part of the service.

Message frequency: During your active membership, you will receive messages daily (Monday through Friday), typically morning and evening. After your membership ends, we may send you up to 30 messages per year.

Opting out: You can stop receiving messages at any time by replying "STOP" to any WhatsApp or SMS message from us. Note that opting out of WhatsApp messages will effectively end the accountability check-in portion of the service.

Message and data rates may apply depending on your carrier and mobile plan.

5. Cookies

We use the following cookies on our website:

Essential cookies: Required for the website to function (login sessions, security).

Google Analytics: Tracks website traffic and user behavior. Retention: 90 days. You can opt out at tools.google.com/dlpage/gaoptout.

Meta Pixel: Tracks ad conversions and helps us target ads. You can manage your ad preferences in your Facebook/Instagram settings.

Stripe: Session-based cookies used on payment pages.

You can block cookies through your browser settings, but doing so may prevent certain features from working properly.

6. Data storage and security

Your information is stored and processed in the United States. If you access our Services from outside the US, you consent to having your data transferred to and processed in the US.

We implement reasonable security measures including encrypted data transmission (HTTPS), secure database storage with regular backups, access controls limiting who can view member data, and password-protected accounts.

No method of electronic transmission or storage is 100% secure. We cannot guarantee absolute security, but we take reasonable steps to protect your information.

7. Data retention

We retain your account information and task data for as long as your account is active, plus a reasonable period afterward (typically 90 days) in case you re-enroll. After that, we delete your information from our production systems. Encrypted backups may persist for up to 90 additional days before being permanently deleted.

We may retain certain information longer if required by law (for example, transaction records for tax purposes) or to resolve disputes.

8. Your rights

Depending on where you are located, you may have the following rights:

Access: Request a copy of the personal information we hold about you.

Correction: Request that we correct inaccurate information.

Deletion: Request that we delete your account and personal information. Upon deletion, your data will be removed from production systems. Encrypted backups are purged within 90 days.

Portability: Request your data in a portable format (CSV or text file).

Objection: Object to processing based on legitimate interests or for direct marketing.

Marketing opt-out: Unsubscribe from any marketing emails using the link at the bottom of each email.

9. Third-party links

Our website may contain links to third-party websites. We are not responsible for the privacy practices of those websites. We encourage you to read their privacy policies before providing them with any personal information.

10. Children

Our Services are not directed at children under 13. We do not knowingly collect information from children. If we learn that a child under 13 has provided us with personal information, we will delete it promptly.
